In accordance with section 3.59 of the Local Government Act 1995, the City of Joondalup gives notice of its intention to enter into a major land transaction.
The City is progressing a project to develop a food and beverage facility on City-managed Crown land within the Burns Beach Coastal Node.
The proposed development site is a portion of Reserve 42219, Lot 11485 on Deposited Plan 217974, 40 Ocean Parade (Burns Beach). The site is approximately 1,000 square metres and is located within a Crown land reserve.
In accordance with section 3.59 of the Act, the City has prepared a Business Plan which is now available for public inspection and comment. A copy of the Business Plan can be found below. Physical copies are also available at the City of Joondalup Administration Building located at 90 Boas Avenue, Joondalup.

To seek community feedback on the City’s Business Plan for the proposed major land transaction for a section of 40 Ocean Parade (Burns Beach).
The City is progressing a project to develop a food and beverage facility on City-managed Crown land within the Burns Beach Coastal Node. Under section 3.59 of the Local Government Act 1995, this is defined as a ‘major land transaction’. For projects such as these, the City is required to prepare a Business Plan and make the Business Plan available for public inspection and comment.
The Business Plan outlines the impact of the project on the City. Section 3.59 of the Local Government Act 1995 has specific requirements for what must be included in the Business Plan as follows:
- Expected effect of the project on the provision of facilities and services by the local government.
- Expected effect of the project on other persons providing facilities and services in the district.
- Expected financial effect of the project on the local government.
- Expected effect of the project on matters referred to in the local government’s current plan prepared under section 5.56.
- Ability of the local government to manage the undertaking or the performance of the transaction.

The proposed development site is located within a Crown land reserve. It is currently managed by the City on behalf of the Department of Planning, Lands and Heritage.
The project includes the construction of a two-storey food and beverage facility. An artist’s impression of the concept design can be found within the Business Plan. The City is proposing to construct the facility, and then lease the facility to commercial operators.
Yes, the City conducted community consultation in 2021. The outcomes of this consultation were reported to the Council in July 2021. A report on the outcomes is available via the Community Consultation section of the City’s website at joondalup.wa.gov.au.
Anyone interested in the proposal can submit feedback. Responses are limited to one per person, or one formal response per club/organisation.
The community consultation period is open Thursday 7 November 2024-Wednesday 18 December 2024.
After the close of the consultation period, the City will consider all feedback received and prepare a report for the Council on the outcomes. The outcomes will also be made available on this Consultation page.
