Liquor licence – Section 39/40 Certificate

A Section 39 and/or 40 Certificate may be required when you apply for a liquor licence. Find out how to apply for the certificates. 

Overview of requirements

  • Planning approval: Section 40 certifies that the use of the premises meets relevant planning requirements.
  • Building approval: To be able to sign an unconditional Section 39, there must be a current occupancy permit/certificate of classification for the same use and class for that premises.
  • Environmental Health approval: To be able to sign an unconditional Section 39, the premises must meet all requirements related to health and food safety. 

Please note: Section 39 certificates are typically required for all new liquor licensing applications and alterations to existing licensed premises. An unconditional Section 39 can only be issued once the premises is built and ready to operate.  

How to apply for a Section 39/40 Certificate

Visit the Department of Local Government Sport and Cultural Industries website and complete the relevant liquor application. 

Ensure you prepare and include these documents with your application: 

  • A detailed site plan showing the location of the premises applying for the liquor licence 
  • A floor plan illustrating the internal layout, with the areas to be licensed clearly marked.

The application fee is due with your application: 

  • Section 40 Certificate: $158 
  • Section 39 Certificate: $163 

Payment methods vary by submission type: 

  • Online: You'll receive an invoice and payment instructions via email. 
  • In person: Pay at the City’s Administration Centre with cash, cheque, EFTPOS, or credit card. Note: Visa or Mastercard payments include a 0.5% surcharge. 
  • Mail: Attach a cheque payable to the City of Joondalup, PO Box 21, Joondalup WA 6919
